Guest Terms & Conditions

Reservations for accommodation by guests (the Guest) are accepted by Waters Edge Stays Ltd (the Owner).

The Agreement: The rental agreement is between the Guest and the Owner. The contract is deemed to have been made once the Guest has paid a deposit and the Owner has dispatched a confirmation of booking. The Guest who makes the booking must be over 21 years of age at the time of booking.

Booking: The Guest who makes the booking is deemed to have agreed to these Terms and Conditions will be responsible for all persons included in the booking and should ensure that they are all aware of these Terms & Conditions. The Owner reserves the right to decline any booking or refuse to hand over a key to any person who has not complied with these Terms & Conditions.

Payment: For bookings made more than 6 weeks before arrival, a deposit (part payment) of 30% of the total cost of the holiday, is required. The balance is due 6 weeks before the holiday commences. For bookings made less than 6 weeks before arrival, the total amount is payable in full on booking.

The Guest agrees to pay the balance of the payment SIX (6) weeks before the holiday is due to start. Email reminders are sent, but delivery cannot be guaranteed. Where a Guest fails to pay their balance by the due date the booking may be cancelled and the deposit retained.

Payment is to be made in Pounds Sterling. If booking with a rate displayed in another currency to this it will be converted into pounds sterling at the exchange rate in force at the time of booking. The Owner cannot be held responsible for rate changes between booking and time of cancellation.

Pricing:  When you make a reservation through our website, the rate you see on your search results page at the time of booking is the accommodation rate for the minimum number of guests.  Additional guests (more than 8) are charged at £20 pppn – up to 2 children under the age of 2 are excluded from guest numbers.  Additional charges for cleaning and linens and pets (if applicable) will be applied and notified prior to confirming the booking.

The rates we advertise are, to the best of our knowledge, correct at the date of publication but we reserve the right to change any rates based on season or availability. Prior to the booking being confirmed rates quoted are based on the rates prevailing at the time but are subject to change. Once a booking has been confirmed we will not change the rate quoted unless you amend the booking or our cost of supplying the accommodation changes as a result of tax changes or currency fluctuations beyond our control.

Care of the Property: The Guests are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings and effects, in or on the property. You must leave them in the same state of repair, and in the same clean and tidy condition at the end of the rental period as at the beginning. You must not use the properties for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties.

We require noise to be kept to a minimum between the hours of 10:30pm and 7am. Smoking is not allowed in any of the properties or in any communal areas.

Damages and damage deposit: Bookings of the properties require a damage deposit of £500.00. You will be required to make this payment by bank transfer or card before your arrival at your accommodation. The refund of this amount will be processed within 2 weeks of your departure (please be aware that it can take 5-10 business days for this to settle in your account), providing the property is left clean and tidy, that there have been no breakages, extra cleaning required or any extra people found to be staying at the property.

In the event that you or anyone staying at the property during your reservation period causes damage or incurs a need for professional cleaning services or leaves the property without settling invoices for additional services or supplies received during your reservation period you will be notified in writing of the details of any extra costs incurred within 7 working days after the end of the reservation period and this amount shall be deducted from the Damage Deposit or payment will be required by you.

Security: Guests will be provided with a key to their house. In the event of a lost key, an additional charge will be made for replacements of £20. If the door lock requires changed, the standard market charge for this will be requested at the time.

Additional Charges: As a guide additional charges include but is not limited to the following:
– Cleaning, specialist treatment charges where more than routine cleaning is required or smoking has occurred: £200-£350.
– Lost door keys: £20 – £100 Depending upon availability / locksmith charges for replacement locks.
– Call out charge for locked out Guests due to key loss etc. £50

Smoking Policy: As per legislation in Northern Ireland, Waters Edge Stays properties are all Non – Smoking.  As such, guests agree not to smoke nor allow smoking inside the property at any time. There will be a full cleaning charge of £350 where smoking occurs. This is to pay for potential close out, furniture, carpet, curtain cleaning specialists etc. Smoking is not permitted in the hot tub.

Safety Notices: For the safety of everyone, please check that all electrical appliances are turned off, including any personal items you have brought with you such as hair straighteners, chargers etc. The use of personal extension leads are not permitted. Please ensure all electrical devices are turned off prior to exiting the cottage.

Leisure Equipment including use of Hot-Tub: You agree that the use of the Leisure equipment is at your (or any third party residing in the property during the period of your reservation) risk in all respects.

You confirm that you are authorised to sign the booking form on behalf of all persons who will occupy the property and that those persons are aware of the booking conditions. You shall be a member of the party occupying the property and are required to ensure that:

1. Each member of the party on whose behalf you have submitted the Booking Form is listed on the booking form with his or her full name and age if under 30;

2. Each member of the party is aware of and will comply with all rules and regulations published by ourselves in respect of the use and occupation of the Properties;

3. The number of persons within the party shall not exceed the maximum number of persons permitted to occupy the property.

Any breach of these provisions will constitute a breach of contract, thereupon we may terminate the booking forthwith in which event all moneys paid by you will be forfeited and you may be required to vacate the property.

We reserve the right to repossess the property at any time where damage or nuisance have been caused by you or any member of your party and in such event we shall not be liable to make any refund whatsoever.

Hot-Tub use:  (Applicable only to Mill House property)  All guests of Mill House must read and agree to the Hot-Tub guidance and disclaimer found here.

Number of People using Holiday Accommodation: The Owner permits the Guest and members of the Guest’s party (but no one else) to occupy the property for holiday purposes only. The Guest must declare the correct number of additional Guests during booking and, if this changes, must inform the Owner before the rental commences of any change. No more than the maximum number of persons stated on the website may occupy a property unless by prior written agreement with the Owner. Extra charges may be applicable if the number of Guests differs from the number on the booking.  Guests are responsible for their visitors. All Non-residents must vacate before 10pm. After this time, the lead guest will be charged for additional guests at the normal accommodation rate.

Arrival/Departure: The properties are available for occupation from 3.00 pm on the first day of the holiday and must be vacated by 10 am on the last day.

Cancellation or Changes by the Guest:

ALL APPLICANTS ARE ADVISED TO TAKE OUT PERSONAL HOLIDAY CANCELLATION INSURANCE.

Bookings can be amended, moved, or cancelled anytime up to 42 (6 weeks) days before check-in. 

Cancellations made by guests more than 6 weeks prior to the check-in date will be refunded.  Refunds will be subject to a 10% administration charge (minimum £25.00) We cannot give refunds or move bookings because of poor weather. 

Cancellations made within 6 weeks of the check-in date will be refunded only if the house can be rebooked at full price for the dates cancelled, in which case the full amount minus the 10% admin charge will be refunded. We will make all reasonable efforts to re-let the accommodation, but if we are unable to do so, then regretfully we will be unable to refund any monies paid.

In the case of exceptional circumstances, when late cancellation of your visit is due to bereavement, illness in the family, or any similar unforeseen occurrence outside your control which prevents you from making your stay, we may consider refunding part or all the money owed with the exception of the 30% deposit. We reserve the right to treat such cases individually. 

Deposits are non-refundable but bookings can be moved in line with our policies. We reserve the right to cancel bookings for reasons deemed necessary by the management, whereupon a full refund will be issued. 

Refunds will be subject to a 10% administration charge (minimum £25.00) We cannot give refunds or move bookings because of poor weather. 

We are not liable for refunds or expenses you incur in the event we are prevented from fulfilling your booking because of circumstances beyond our control.

 Deposits are 30% and balance payments are due 6 weeks before arrival. If balance payments go past 30 days the booking will be cancelled

Pets: The Guest may only bring such pets as are booked in by the Guest at the time of booking. A charge will be made per pet. Not all properties accept pets; if property details on the website stipulate no pets then this is binding within these Terms & Conditions. Pets must be well-behaved and should not be left unattended in the property. They are not permitted in the bedrooms or on any furniture in the property. If damage or extra cleaning is caused by pets the Guest may be billed for that charge. ‘No Pets’ in a description may not guarantee that pets have never occupied the property. No garden is guaranteed as secure for dogs even if described as private or enclosed.

Guest Responsibility: The supervision of children, babies, dogs and any adults requiring care remains the responsibility of the Guest at all times.

Guests should not leave any items at the property and, if left, the Owner has the right to charge for the removal, return or disposal of those items.

Access: Guests must allow reasonable access to the property by the Owner for maintenance given reasonable notice.

Property descriptions and all details both written and verbal are given in good faith and believed to be correct, but interpretation thereof can be subjective and as such their accuracy cannot be guaranteed. Property details may vary over time from photographs and descriptions on the websites.

Liability: The Owner cannot accept responsibility for any material loss, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property, its plumbing, gas, electrical services or exceptional weather.

No responsibility is accepted for loss or damage of property, (including pets), vehicles or vehicle contents belonging to the Guest or any member of the party during their occupancy.

The maximum liability accepted by the Owner will be the total cost of the holiday as paid by the Guest to the Owner. No other expenses such as travelling costs or alternative accommodation will be accepted.

Cancellation by Owners: The Owner reserves the right to refuse any booking and to cancel any bookings already made if the property is unavailable (eg through fire, flood, etc) for any reason whatsoever, subject to a full refund of all monies paid (but no further liability). The Owner shall not be under any other liability if such cancellation occurs. Note: in the unlikely event of a cancellation the Owner will make every possible effort to secure alternative accommodation if required.

Force Majeure: The Owner cannot accept responsibility or liability for any alterations, delay or cancellation or any other loss or damage caused by war, civil strife, terrorist action, industrial disputes, fire, sickness, bad weather, epidemics, acts of any government or public authority, or any other event outside our control.

Waiver: The failure of the Owner to enforce or exercise, at any time or for any period of time, any term of, or any right pursuant to this agreement does not constitute and shall not be construed as a waiver of such term or right.

Miscellaneous: The Guest agrees that the contract with the Owner is made at the Owner’s premises and that any proceedings between the parties shall be conducted in the Court nearest to the Owner.

Use of our websites and services are bound in accordance with these Guest terms and conditions and our privacy policy which outlines how we use and protect your data in delivery of these services
